The U.S. Department of Labor’s Employment and Training Administration (ETA) has issued Training and Employment Notice (TEN) No. 21-24, Change 1, officially canceling TEN 21-24, which had previously directed recipients of federal workforce funding to immediately cease DEI–related activities under two Executive Orders issued in January 2025 DOL+1.

Why this matters:
A preliminary injunction was granted on February 21, 2025, in the case National Association of Diversity Officers in Higher Education v. Trump (25-cv-333), based in the District of Maryland. As a result, ETA has rescinded TEN 21-24 effective immediately DOL.

Summary for our members:

  • The directive to halt DEI/DEIA initiatives—outlined in TEN 21-24 following January 2025 Executive Orders—is no longer in effect.
  • DEI-related programming and activities can resume under existing federal financial assistance guidelines, absent further guidance from ETA.
